Which States Have a Vape Flavor Ban?

As vaping laws evolve in 2025, certain states have moved beyond restricting age or public use to explicitly banning flavored e-cigarette products—except tobacco and, in some cases, menthol.

If you've noticed fewer vape flavors on the market lately, it's not your imagination. Several states across the U.S. have implemented restrictions or outright bans on flavored vape products, especially those that are fruit, candy, or dessert-inspired. These bans are mostly aimed at reducing youth vaping but affect all adult users too.

As of 2025, states like Massachusetts, New York, New Jersey, and Rhode Island have some of the strictest laws. Massachusetts led the way with the first statewide ban in 2019, and now only allows tobacco-flavored vapes to be sold. New York followed with similar restrictions, banning all non-tobacco and non-menthol flavors and also outlawing online vape sales. New Jersey and Rhode Island both only allow tobacco and sometimes menthol products, cutting out the rest of the flavor spectrum entirely.

Utah joined the list in 2025, restricting vape sales to tobacco and menthol options and tightening rules around online ordering. The District of Columbia also bans flavored vapes altogether, part of a broader effort to limit youth access to nicotine.

California was one of the earliest states to ban flavored vapes at the local level, and now the restriction is statewide. Retail stores can no longer sell non-tobacco or non-menthol vape products, and online retailers are blocked as well. Washington State is currently considering similar legislation, and it may pass later this year.

On top of state laws, many cities have local bans. Places like Chicago, Denver, and Columbus have passed their own flavor restrictions, meaning some areas enforce tighter rules than their state governments.
